Stablecoin restrictions, transaction safeguards, and US custody proposals
Three official updates for beginners: what EU platforms may restrict, a proposed Ethereum safety mechanism, and how to read new US custody proposals.
ESMA tells EU crypto providers to stop services for non-compliant stablecoins
ESMA’s October 8 opinion says MiCA-authorised crypto-asset service providers should cease services involving stablecoins that do not comply with MiCA. National authorities should prevent clients from acquiring or increasing exposure and address remaining pre-existing exposure within three months; limited services may continue only for liquidation, conversion, withdrawal, transfer, or safekeeping. For EU users, token availability can therefore depend on both a stablecoin’s compliance and the service offered by the platform.

The Ethereum Foundation describes native transaction assertions: signed rules could inspect a transaction’s net state changes and revert it when a minimum output, spending cap, or approval constraint is violated. The work cites EIP-7906 as one possible approach, but the design is still being developed and is not confirmed for the Hegotá upgrade. It is not protection users have today, so careful review, clear signing, simulation, and independent limits remain important.

The US Securities and Exchange Commission has proposed a custody framework for crypto assets held by registered investment advisers and regulated funds, including self-custody under certain circumstances and the use of state trust companies as custodians. The proposal remains open to public comment and is not a final rule or a general endorsement of crypto self-custody for every investor.
